Provider and agreement
FlapUps is provided by Alexander Mayle, trading as Abenteuergeist, Widenmayerstraße 11, 80538 München, Germany (“Abenteuergeist”, “we”, “us”). These terms govern your use of the FlapUps iPhone application and related services. By using FlapUps, you agree to these terms and our Privacy Policy. Apple’s Standard Licensed Application End User License Agreement also applies to the licensed iOS application; these terms govern the additional FlapUps service.
Eligibility and accounts
You must be at least 13 years old and legally able to enter into this agreement. You are responsible for activity under your account and for keeping your device and sign-in credentials secure. Information you provide must be accurate and current.
Movement and safety
FlapUps is a recreational fitness game, not a medical device, treatment or substitute for professional advice. Use a clear, well-lit space, place your iPhone on a stable support and choose a comfortable range of motion. Stop immediately if you feel pain, dizziness or unusual discomfort. Do not use FlapUps where movement could endanger you, another person, your device or property. You are responsible for deciding whether an exercise is suitable for you; consult a qualified professional if you are unsure.
Playable demo
FlapUps may provide one short, bounded onboarding game before the subscription screen. This is a product demonstration and is not a free subscription trial. Access to the subscription features requires an active entitlement.
Subscriptions and billing
FlapUps offers auto-renewing weekly and annual subscriptions. The exact localized price and billing period are displayed by Apple before purchase. No introductory free trial is currently offered. Payment is charged to your Apple Account when you confirm the purchase.
Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Apple manages billing, renewal and cancellation. You can manage or cancel in iPhone Settings → your name → Subscriptions or at apps.apple.com/account/subscriptions. Deleting FlapUps or your FlapUps account does not cancel an Apple subscription. Access continues through the paid period after cancellation, subject to Apple’s purchase rules.
Purchases and refunds are handled under Apple’s applicable terms and policies. If a purchase is not recognized after reinstalling or changing devices, use Restore Purchases in FlapUps.
License and intellectual property
We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use FlapUps on Apple devices you own or control, subject to Apple’s usage rules. FlapUps, its software, original characters, artwork, text and branding are owned by Abenteuergeist or its licensors. No ownership rights are transferred to you.
Acceptable use
You may not misuse the service, interfere with its operation or security, attempt unauthorized access, submit false purchase or game records, use automated methods to manipulate scores, distribute malware, infringe another person’s rights, or reverse engineer the app except where applicable law expressly permits it.
Availability and changes
We may maintain, improve, modify or discontinue features. Internet access, compatible hardware, camera permission and third-party services may be required. We do not promise that pose estimation will be perfectly accurate, uninterrupted or available in every environment. We will not remove access you have already paid for except where required for security, law, platform rules or a serious breach of these terms.
Account suspension and deletion
You may delete your account from the app at any time. We may suspend or terminate access if you materially breach these terms, misuse the service or create a security risk. Where reasonable, we will give notice and an opportunity to resolve the issue. Sections that by their nature should survive termination continue to apply.
Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for intent, gross negligence, injury to life, body or health, or mandatory consumer rights. Otherwise, we are liable for foreseeable damage caused by a material contractual breach; for minor negligence, liability is limited to damage typical for this type of agreement. You remain responsible for safe movement and placement of your device.
Governing law and consumers
German law applies, excluding its conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections in your country of residence. Statutory courts have jurisdiction. Consumers may also have access to local dispute-resolution procedures; we are neither required nor willing to participate in dispute resolution before a German consumer arbitration board.
Changes to these terms
We may update these terms for legal, security or product changes. We will post the updated version and date here. If a change materially affects your rights, we will provide reasonable notice where required. Changes do not retroactively alter an already paid subscription period.
